Yes. In most cases a deceased estate property can be sold before the estate itself is formally finalised, provided the executor has been issued Letters of Executorship and has the necessary authority (and, where required, consent from the Master of the High Court or the heirs) to proceed with a sale. The property doesn’t need to sit unsold until every other estate matter is wrapped up.
What does the executor actually need before listing the property?
Valid Letters of Executorship from the Master’s Office is the starting point. Without this, the executor has no legal authority to sign a sale agreement on the estate’s behalf at all. Depending on the estate’s value and complexity, the Master’s Office may also require sign-off on the proposed sale price or process before transfer can proceed.
Does the sale have to wait for the Liquidation and Distribution account to be approved?
Not necessarily. A sale can often be concluded, and even transferred, before the full Liquidation and Distribution account is finalised, though the proceeds themselves are usually held and only paid out to heirs once that account is approved. The sale and the final distribution of money are two separate steps, not one.
What actually stalls a sale in this situation?
Most delays come from incomplete paperwork at the executor-appointment stage, not from some rule requiring the whole estate to close first. An executor without finalised Letters of Executorship, or without clarity on which heirs need to consent, is the most common reason a genuinely sellable property sits on the market unsold for months.
Short answer: A deceased estate property can usually move to market well before the estate itself is fully wound up. The real constraint is whether the executor’s authority and heirs’ consent are properly in place, not an arbitrary waiting period.
